Synopsis: The Tamil Nadu government filed its counter-affidavit before the Supreme Court in connection with the deaths following a stampede in Karur, in response to the petition filed by the TVK. The Tamil Nadu government asserted that the investigation by the state police was fair and unbiased.
The Tamil Nadu government on Tuesday, 2 December, filed its counter-affidavit before the Supreme Court in connection with the deaths following a stampede in Karur, in response to the petition filed by the Tamilaga Vettri Kazhagam (TVK).
In its reply, the state government has requested the Supreme Court to cancel the CBI investigation into the case and to hand over the probe back to the Special Investigation Team (SIT) constituted earlier by the Madras High Court.
The government also sought the lifting of the stay imposed on the inquiry being conducted by the one-man commission headed by Justice (retd.) Aruna Jagadeesan, so that the commission’s investigation into the Karur incident can be resumed.
A stampede during a political rally organised by TVK chief Vijay in Karur on 27 September cost the lives of 41 people and injured several others.
The Tamil Nadu government asserted that the investigation carried out by the state police was proceeding in the right direction and was being conducted in a fair and unbiased manner.
It pointed out that the Madras High Court had constituted the SIT, headed by a senior IPS officer, and had also made it clear that the investigation would be monitored by the court itself.
The state further submitted that, at the same time, it had exercised its lawful authority to constitute a one-man commission to independently inquire into the incident. The proceedings of the commission had commenced and were being carried out freely and independently.
However, the government stated that when the case relating to the Karur stampede was transferred to the CBI, the inquiry by the one-man commission was stayed, and the investigation by the SIT was also set aside. In view of these developments, the state urged the Supreme Court to pass a balanced and impartial order in the interest of justice.
Specifically, the Tamil Nadu government has requested the apex court to cancel the CBI probe, permit the continuation of the investigation by the SIT of the Tamil Nadu Police, and allow the one-man commission to proceed with its inquiry into the Karur incident.
