2017 actor assault case: Survivor’s counsel moves Kerala High Court against trial court judge

Synopsis: The counsel for the survivor in the 2017 actor assault case in Kerala made serious allegations against Ernakulam Principal Sessions Court Judge Honey M Varghese in a petition submitted to the Chief Justice of the Kerala High Court. Calling remarks of the judge against her defamatory and contemptuous, Mini alleged that the judge showed undue favour towards actor Dileep.

The counsel for the survivor in the 2017 actor assault case in Kerala made serious allegations against Ernakulam Principal Sessions Court Judge Honey M Varghese in a petition submitted to the Chief Justice of the Kerala High Court.

Speaking to South First, Advocate TB Mini said she was not criticising the court but stressed that every judgement must align with principles of social justice. The proceedings are expected to be initiated based on Section 2(c) of the Contempt of Court Act.

She said she had the right to raise concerns and denied responsibility for the alleged memory card leak from the high court, calling it a major lapse.

On Monday, while considering a batch of contempt of court petitions related to the case, the judge inquired about the absence of Mini to her junior, who was present in the court.

Later, Varghese said Mini was careless in conducting the case and was seldom present in the court during the trial.

‘Unfair and false’

Mini claimed this was the first instance in judicial history where a court made derogatory remarks against a lawyer in front of the media, which could harm an advocate’s career. She said such comments, especially when made before the media, were unfair and false.

The judge reportedly remarked that she dozed off during hearings and handled the case casually.

Calling these remarks defamatory and contemptuous, Mini alleged that the judge showed undue favour towards actor Dileep.

These allegations come as the Kerala High Court is set to hear bail pleas filed by six convicts on 4 February. In her petition, Mini stated that from the early stages of the trial, the judge made derogatory comments about the survivor and behaved discourteously towards the prosecution.

She alleged that this conduct eventually led to the resignation of two Special Public Prosecutors.

Mini further claimed that the judge regularly made inappropriate remarks about the survivor and prosecution witnesses, and that on several occasions, the Special Public Prosecutor had to remind the court that such behaviour went against SC guidelines.

According to her, the alleged bias resulted in a serious miscarriage of justice and brought disrepute to the judicial system.
