Respite for BJP veteran MP Renukacharya as high court orders against initiating coercive action against the former MLA for his alleged inflammatory speech.

Synopsis: Renukacharya moved the high court for quashing the FIR, registered for allegedly prompting youngsters to play DJ music during a Ganesha idol procession, in defiance of the district administration.
The Karnataka High Court on Wednesday, 24 September, made a strong oral observation that festivals were being used for political reasons, including by the state government.
“One thing…festivals are being used for political reasons by the state government also. This should not be done,” the court remarked while staying any coercive steps against BJP leader MP Renukacharya.
The BJP leader, a former MLA, has been booked for allegedly making inflammatory speeches during the Ganesh Chaturthi festival celebration in Davanagere. He allegedly urged youths to defy the district administration’s order banning DJ music during a Ganesha idol immersion procession.
Renukacharya approached the high court requesting an order to quash the FIR against him. He argued that his speeches were twisted and wrongly reported.
The FIR has been lodged under BNS Sections 126(2)(wrongful restraint),189(2)(unlawful assembly),190(Every member of unlawful assembly guilty of offence committed in prosecution of common object),285(Danger or obstruction in public way or line of navigation), Live Law reported.
After hearing the arguments, Justice MI Arun restrained the authorities from initiating coercive action against the BJP leader. “Respondents are directed not to initiate any coercive steps against the petitioner. The petitioner shall co-operate with the investigation,” the court ordered.
The court will take up the matter again after vacation.
