Synopsis: A Supreme Court hearing descended into chaos on Friday after a litigant appearing in person “ordered” the Bench to direct the registration of an FIR against an IPS officer, hurled papers at the judges and verbally abused them before security personnel intervened. The Bench of Justices KV Viswanathan and Alok Aradhe chose not to initiate proceedings over the litigant’s conduct and instead dismissed the Special Leave Petition on merits.

The Supreme Court witnessed dramatic scenes on Friday, 10 July, when a litigant appearing in person in a Special Leave Petition (SLP) “ordered” the Bench to direct the registration of an FIR against an IPS officer before hurling papers at the judges and verbally abusing them, LawBeat reported.

The incident occurred before a Bench of Justices KV Viswanathan and Alok Aradhe, which was hearing a petition filed by Prabal Pratap challenging an Allahabad High Court order declining to interfere with a trial court’s decision.

“Mr Judicial Servant, I order you to order the registration of an FIR against ACP Vikas Nagar, Lucknow, and Duplex Technology… because I am the sovereign,” the petitioner is heard telling the Bench, prompting the judges to ask, “You are ordering us?”

The petitioner then continued his submissions before suddenly flinging a bundle of papers into the air, prompting security personnel to intervene.

The Bench declined to initiate proceedings over the litigant’s conduct and dismissed the SLP.

“…considering the condition of the petitioner, we do not propose to take any action against him. As far as the merits of the case are concerned, we have perused the records. We find no good grounds to interfere with the impugned order. The Special Leave Petition is dismissed,” the judges observed.

SCACA seeks action

The Supreme Court Arguing Counsel Association (SCACA) has urged the Chief Justice of India to take “strong and strict action” against all those allegedly involved in the incident, directly or indirectly, according to Bar and Bench.

In a representation, the association said the episode was an attack on the dignity, decorum and authority of the Supreme Court and sought action in accordance with law against those responsible.

It said the recurrence of such incidents was a matter of serious concern, recalling an earlier courtroom episode in which those involved had been pardoned, but their conduct was later glorified by what it described as “anti-social and anti-institutional elements.”

The association also alleged that certain YouTube channels, social media handles and “self-styled journalists” had been selectively circulating courtroom clips out of context and using them to make “abusive, scandalous, and defamatory remarks” against judges, thereby eroding public confidence in the judiciary.

It called for immediate institutional intervention and stringent measures to protect the dignity, independence and authority of the institution and to deter similar incidents in future.
