Cash for MLAs: High court postpones hearing on plea challenging special court order to free the accused

The special court cited a lack of evidence while ordering the release of three men detained for the alleged attempt to buy TRS MLAs.

The High Court of Telangana on Friday 28, October, deferred by a day the hearing on a police petition challenging a special court order to free three men detained for allegedly trying to lure TRS MLAs to defect to BJP.

The court will take up the case on Saturday, 29 October.

The Cyberabad police approached the high court after the special court at Sarronagar on Thursday, 27 October,  rejected their plea seeking the custody of the suspected BJP emissaries.

The high court had initially scheduled the hearing for Saturday but took it up on Friday itself. While deferring the hearing, the court directed the accused to be in Hyderabad for the next 24 hours.

They were also directed to furnish the details of their stay to the Cyberabad Commissioner of Police. The court also instructed them not to consult anyone connected with the case.

The Cyberabad police had on Wednesday, 26 October, raided a farmhouse at Aziznagar in Cyberabad’s Moinabad area and foiled an alleged bid to lure four TRS MLAs with money, central government contracts and senior positions, in exchange for defecting to the saffron party.

Three persons, Ramachandra Bharathi, alias Satish Sharma, a resident of Faridabad, Nanda Kumar of Hyderabad, and Simhayaji Swamy of Tirupati were detained in connection with the case.

Why the special court rejected the police plea

While dismissing the police petition, the special court judge observed that there was no evidence to establish that money was offered to the MLAs. No cash was seized from the farmhouse on Wednesday, the judge said.

Ordering their immediate release, the judge told the police — if they want to pursue the case — that they could serve a notice under Section 41 (provision to arrest without a warrant) of the Criminal Procedure Code to elicit information and evidence from them.

After the judge ordered to set the men free, the police immediately issued a summons, asking the men to appear before the investigators within 24 hours and approached the high court.

Bandi denies charges, swears by God

Meanwhile, mild tension prevailed for some time at the Lakshmi Narasimha Swamy Temple in Yadadri on Friday, 28 October,  when BJP’s Telangana state president Bandi Sanjay Kumar went there to swear by God that his party was not connected with the “attempt to purchase TRS MLAs.”

After swearing by God, he performed special pujas to the presiding deity.

Kumar on Thursday, 27 October, had dared Chief Minister K Chandrasekhara Rao to swear in front of the deity that the Aziznagar farmhouse incident was genuine.
