The Telangana High Court on Monday, 27 February, dismissed the bail petition of Sunil Yadav, who is one of the accused in the murder of former MP YS Vivekananda Reddy, who represented the Kadapa constituency of Andhra Pradesh in the Lok Sabha.

While rejecting the bail, the court said that the transparent probe and protection of the witnesses were of paramount importance.

Referring to the claims made by the defence counsel that Sunil Yadav’s name did not figure in the probe carried out by the police in Andhra Pradesh after the murder in March 2019, the court said the case was handed over to the CBI since the Andhra Pradesh Police failed to conduct it properly.

The arguments

The CBI informed the court that bail could not be given to Sunil Yadav as the ongoing investigation was at a crucial stage.

It said that the probe into the involvement of several influential politicians was on, so bail should not be granted to him.

The CBI said that Sunil Yadav met influential politicians before and after the murder, and this has been determined through Google Takeout.

If bail was granted to Sunil Yadav, it would have an impact on the ongoing investigation and he might also threaten the witnesses, it argued.

Vivekananda’s wife Soubagyamma and daughter Sunitha’s advocates argued that Sunil Yadav, who was associated with politicians, was the conspirator in the murder and several witnesses had already been impacted because of him.

As the investigation into the involvement of other conspirators was still on, the bail should not be given to him, they said.

Responding to the arguments of the defence counsel and advocates of the CBI, the court made it clear that bail could not be granted to Sunil Yadav since the investigation was still on.

A few days ago, the CBI questioned YSRCP MP YS Avinash Reddy at its office in Koti and collected additional details about the case.
