Supreme Court takes objection to Revanth Reddy’s political comment over Kavitha’s bail; silent on Bandi Sanjay

The Supreme Court on Thursday, 29 August, took strong objection to Telangana Chief Minister A Revanth Reddy alleging a nexus between the BJP and the BRS in obtaining bail for MLC K Kavitha in cases linked to the alleged Delhi excise policy scam.

Irked over Revanth Reddy’s statement, the top court said such statements might create apprehensions in the minds of people.

However, the court did not take any note of Union Minister of State for Home Affairs Bandi Sanjay Kumar alleging that the BRS leader got bail after the pink party ceded a Rajya Sabha seat to the Congress.

Questions the statement

“Have you read in the newspaper what he said? Just read what he has stated. What sort of statement is this by a responsible chief minister? That might rightly create apprehension in the minds of people. Is this the kind of statement that should be made by a chief minister? A constitutional functionary is speaking in this manner?” the apex court asked.

“Why should they drag court in political rivalry? Do we pass orders on consultations with political parties. We are not bothered by politicians or if anybody criticises our orders. We do our duty as per conscience and oath,” a three-judge bench headed by Justice BR Gavai told senior advocate Mukul Rohatgi, appearing for Revanth Reddy.

In an interaction with reporters on Tuesday, Revanth Reddy said there were doubts over MLC Kavitha getting bail in five months when Manish Sisodia got it after 15 months and Kejriwal is yet to get it.

“It is a fact that BRS worked for the victory of the BJP in the 2024 LS polls. There is also talk that Kavitha got bail because of the deal between BRS and BJP,” he had alleged.

The apex court said it is a fundamental duty to have mutual respect for institutions and maintain arm’s distance.

“We always say we will not interfere in the legislature, then that is expected from them also. Do we pass orders on political considerations?,” the bench also comprising Justices PK Mishra and KV Viswanathan observed.

The top court was hearing a petition seeking a transfer of the trial in the 2015 cash-for-vote scam case, in which Revanth Reddy is an accused, from the state to Bhopal.

Allegations by Bandi Sanjay

In a post on X on Tuesday, Bandi Sanjay alleged that bail was secured for Kavitha by Congress lawyers after BRS supremo K Chandrashekar Rao supported the grand old party’s candidate in the Rajya Sabha election from Telangana.

“Congratulations to the Congress party and its advocates for securing bail for BRS MLC in the infamous liquor Scam. Your untiring efforts finally yielded fruits. This bail is a win for both BRS and Congress — BRS leader is out on bail & the Congress man gets to Rajya Sabha,” he wrote on X.

“Remarkable political acumen by KCR in supporting the candidate, who initially argued for the bail, to be nominated to Rajya Sabha unopposed by the ruling Congress Congratulations to the partners in crime who wine & dine,” the BJP leader added.\
