‘If anything, I am a victim’: BRS MLC K Kavitha says in her letter to Rouse Avenue Court

She said that majority cases of ED/CBI are against Opposition leaders and when the accused persons join BJP, the investigation abruptly stops.

Claiming that she was a victim in the alleged Delhi Excise Policy scam, BRS MLC K Kavitha on Tuesday, 9 April, wrote to the judge of Rouse Avenue District Court in New Delhi and denied her involvement in it.

She said she was neither involved in the case nor was a recipient of any financial gain.

After the court denied her request to speak in the court, she obtained permission to write a letter.

The BRS leader said: “I was neither involved nor gained any financial benefit from the said matters in the case. If anything, I am a victim.”

Cites absence of solid proof 

The daughter of BRS supremo and former Telangana chief minister K Chandrashekar Rao claimed that the investigation agencies did not have any solid proof against her.

She said: “In the last two and half years of investigation, both ED (Enforcement Directorate) and CBI conducted multiple raids, harassed me physically and mentally, coerced and threatened me and arrested many people. All that they could accumulate was a bunch of statements from a few people who kept changing their statements and their political alliances.”

The BRS leader said that the ED arrested her on 15 March without any shred of evidence and took action just on the eve of the general elections.

She claimed that the entire nation witnessed the “never-ending ED/CBI investigation” for the past two and a half years and that it had turned into a media trial.

“Being a woman politician, I am the most victimised in the process, severely denting my personal and political reputation. My personal mobile number was displayed on all television channels, directly invading my privacy,” she said in the letter.

‘Cooperated with the agencies’

She said she had time and again cooperated with both the investigation agencies.

“I have appeared before them four times. I have answered all their questions to the best of my knowledge and gave all the bank and business details. I willfully cooperated with the agencies by submitting all of my mobile phones that the agencies blamed me of destroying.

She recalled Justice Sanjiv Khanna (of the Supreme Court) himself saying that there was no money trail, no proof of corruption and that this case could be thrown away.

Kavitha said that the ED blamed her of manipulating witnesses which did not hold water. “If that was the case how come they (CBI and ED) did not arrest me when our party (BRS) was in power (in Telangana)?” she asked.

She said that the ED had arrested her despite giving an undertaking to the Supreme Court that no coercive action would be taken against her.

‘Majority of cases are against Opposition’

She said that 95 percent of the cases of ED/CBI are against the Opposition party leaders and when the accused persons join the BJP, the investigation abruptly stops.

The BRS leader said that on the floor of the Parliament, BJP leaders openly threatened the Opposition: “Chup ho jao, warna ED bejunga. (Be silent or ED will be sent).”

Kavitha pleaded with the judge to consider her application for bail since she had to be with her younger son to lend him moral support as he was preparing for his board examinations and aptitude tests and wondered if a mother is replaceable.

She said she has to be with her son as it is a make-or-break year for him.

Calling herself a dutiful mother, she said she is highly qualified and can understand the importance of her role as her minor son prepares for his examinations.

The BRS leader reminded the judge that she had been cooperating with the investigation agency and would continue to do so in future.

She ended her letter by saying: “In this dire situation, the Opposition parties are looking up to the judiciary with great hope to give us respite.”

The ED has accused Kavitha of being the kingpin of the so-called South Group, which allegedly paid ₹100 crore to AAP leaders to tweak the now-scrapped Delhi Excise Policy 2021-22 to suit them.
