SCBA chief’s letter to President can attract contempt

Senior Advocate Sanjay Hegde says SC in its advisory jurisdiction cannot overturn judgments delivered under its adjudicatory jurisdiction.

The executive committee of the Supreme Court Bar Association has distanced itself from the letter to the President of India about a hold on the electoral bond verdict and a reference written by its president, Adish C Aggarwala. That does not settle the issue because seeking stay on the verdict means obstructing the judicial process and that can attract contempt.
