SC lays down the law for ED in money-laundering case

'If accused appears before the special court by summons (issued by court), it cannot be treated that he is in custody, Supreme Court said.

The Supreme Court on Thursday, 16 May, held that the ED could not arrest an accused under Section 19 of the PMLA after a special court had taken cognisance of the money-laundering complaint. It said when an accused appears before a court in pursuance of a summons, the agency would have to apply to the court concerned to get custody.
