If only the country were a fully functional democracy with the rule of law as the guiding principle, the judgement of the Nagpur Bench of the Bombay High Court in the infamous case involving Prof GN Saibaba and five others would have stirred up a hornet’s nest. The present judgement raised several serious questions before the Indian judiciary.
