Arvind Kejriwal withdraws plea against ED arrest from Supreme Court, to fight remand first

Delhi Chief Minister Arvind Kejriwal withdrew from the Supreme Court on Friday, 22 March, his petition challenging his arrest by the Enforcement Directorate in connection with the Delhi Excise Policy case.

A Special Bench of Justices Sanjiv Khanna, MM Sundresh and Bela M Trivedi agreed to take up the challenge petition.

However, Kejriwal’s counsel, Senior Advocate Abhishek Manu Singhvi, told Justice Khanna that the petition was being withdrawn as it clashed with the remand petition.

That is, the Enforcement Directorate would be approaching a Delhi court on Friday to seek Kejriwal’s remand.

Singhvi said they would fight the remand first and then appear before the bench.

Kejriwal would now contest the remand proceedings before the trial court and then return to the apex court with another petition.

“You may go there (before trial court). Just write an e-mail to the registry. We will see,” Justice Khanna told Singhvi.

Singhvi said, “I will write a letter to the registry. I had to mention this again before this court so that it is convenient for your lordships”.

The move came hours after Justice Khanna told Singhvi that a three-judge bench would hear Kejriwal’s petition against his arrest during the day.

Kejriwal moved the Supreme Court late Thursday after the ED arrested him.

He was arrested hours after the Delhi High Court refused to grant protection to the AAP national convenor from any coercive action by the agency.
