ECI goes to Supreme Court seeking copies of secret bond documents in sealed cover

The Election Commission submitted to the Supreme Court that it had not retained any copy of the documents in sealed covers.

On Thursday, 14 March, the Election Commission (EC) moved an application seeking modification of the Supreme Court judgment in the electoral bonds case related to confidential information in sealed covers.

The application was made after the EC uploaded the electoral bond details given to it by the SBI.

The EC requested that the court give it copies of the sealed-cover documents it furnished as it had not retained any.

As per Live Law, the Election Commission, in its latest application, pointed out that the Supreme Court observed in the 11 March order: “Copies of the statements which the ECI filed before this court would be maintained in the Office of the ECI.”

Mentioning that it had not retained any copies of the documents, the ECI sought a modification of the above observation in the order.

The new plea

The EC said in its fresh application: “In compliance with the Court’s order and to maintain the confidentiality of the information/data, the Election Commission forwarded the documents received by it to this court in sealed covers/boxes, without retaining any copies of the same.”

It added: “Thus, no copies of the documents/statements filed by the EC before this Court in the instant case were ever retained by it.”

In its earlier order, the Supreme Court had told the EC that it should “forthwith publish the details of the information which was supplied to this Court in pursuance of the interim orders on its official website”.
