The notice said that Kanugolu would be arrested if he fails to appear in connection with a case registered against INClusive Minds.
The cybercrime wing of the Hyderabad City Police on Tuesday, 27 December, issued a notice to Congress’s poll strategist Sunil Kanugolu, asking him to appear before investigators for an inquiry on 30 December.
The notice was issued under Section 41(A) (notice of appearance before a police officer) of the Criminal Procedure Code. Telangana Pradesh Congress Committee vice-president Mallu Ravi received the notice on behalf of Kanugolu.
The notice stated that the inquiry is in connection with a case registered on Saturday, 24 December, against Kanugolu under IPC sections 469 (harming the reputation of a person) and 505 (2) (creating or promoting hatred).
The cybercrime police had raided the INClusive Minds’ office at Madhapur on 13 December over allegations of operating social media pages that posted morphed and derogatory content against Telangana Chief Minister K Chandrashekhar Rao.
The notice directed Kanugolu to appear before the investigation officer at 11 am on Friday, 30 December, and offer an explanation.
The cybercrime police have also directed the Congress’s poll strategist to comply with as many as 10 conditions listed in the notice
The conditions included not tampering with evidence or issuing threats to any person related to the case, and also to produce all relevant documents required for the probe.
The notice added that Kanugolu could be arrested under sections 41 A (3) and 4 of the CrPC if he fails to appear before the police as directed.
“The conditions are like those of airlines issue when one buys an aeroplane ticket,” Ravi told South First.
Terming it a routine inquiry, the senior Congress leader said that Kanugolu would present himself before the police. He denied receiving a copy of the First Information Report (FIR).
“We have received only this notice,” he added.
On 14 December, the police sealed Kanugolu’s INClusive Minds office — the same day on which Chief Minister Rao inaugurated the BRS office in Delhi.
The police deemed the critical and satirical social media posts against KCR and other BRS leaders “objectionable”. The posts were deleted and electronic devices were confiscated.
Three members of Kanugolu’s team were arrested and booked under IPC sections 469 and 505 (2).
The Congress is backing Kanugolu. The party has hired his firm, Mindshare Analytics, to strategize its campaigns for the upcoming Karnataka elections and later in Telangana.
