Rahul Easwar remanded to judicial custody after court dismisses bail plea

Easwar has been publicly backing Mamkoottathil since the controversy broke out, asserting that the MLA is being falsely accused.

Synopsis: The court cited digital evidence produced by the prosecution, which alleged that Easwar had made online statements that indirectly revealed the identity of the complainant in the sexual assault case against suspended Congress MLA Rahul Mamkoottathil.

Activist Rahul Easwar was on Monday, 1 December, remanded to 14 days in judicial custody after the Thiruvananthapuram District Court dismissed his bail plea.

The court cited digital evidence produced by the prosecution, which alleged that Easwar had made online statements that indirectly revealed the identity of the complainant in the sexual assault case against suspended Congress MLA Rahul Mamkoottathil.

Easwar was taken into custody on Sunday, 30 November, by the Cyber Police following a complaint filed by the woman, who accused him of contributing to a coordinated social media campaign aimed at defaming her and circulating her photographs.

Based on her complaint, the police registered a case and issued a notice summoning Easwar for interrogation.

Officers reached his house around 5 pm and served the notice, after which Easwar, accompanied by his wife and a police officer, appeared at the Armed Reserve Police Camp in the city for questioning.

Investigators examined his mobile phone, laptop, and social media accounts during the probe.

Following more than three hours of interrogation, the police recorded his arrest.

The case

A case has also been registered against Kerala Pradesh Congress Committee General Secretary Sandeep Warrier, Pathanamthitta Mahila Congress District General Secretary Ranjitha Pulikkal, and Supreme Court lawyer Deepa Joseph.

According to the charge sheet, Ranjitha Pulikkal is the first accused, Deepa Joseph the second, while Sandeep Warrier is listed as the fourth accused. Easwar has been named the fifth accused.

The accused have been booked under Sections 43 and 66 of the IT Act, and Sections 72 and 79 of the Bharatiya Nyaya Sanhita (BNS).
