Two district judges from Kerala on Monday, 2 September withdrew their petitions in the Supreme Court against them not being considered for appointment as high court judges.
Thrissur Principal District Sessions Judge PP Seythalavi and Thalassery Principal District Sessions Judge KT Nisar Ahmed filed writ petitions challenging their exclusion from the list of judicial officers recommended for elevation by the Kerala High Court Collegium.
The petitions were withdrawn after a Supreme Court bench comprising Justice Hrishikesh Roy and Justice SV Bhatti said the recommendations were not enforceable.
Both judges, who entered the judicial service in 1997 and have 27 years of experience, were omitted from the list of candidates prepared by the Kerala High Court Collegium in June and forwarded to the Supreme Court Collegium for appointments.
They argued that despite being eligible, their names were not recommended, prompting them to seek judicial intervention.
Taking up the petition the court asked: “What kind of petition is this? The senior officer is not being considered by the High Court collegium, you will come here and enforce?”
However, when the counsel for the petitioners tried to offer an explanation, the court said: “These are not enforceable things.”
The counsel informed the court that the petitions would be withdrawn and sought permission to pursue other remedies.
However, the court did not permit that and asked them to withdraw the petition or obtain an order of dismissal.
Subsequently, the petitions were withdrawn.
