Court orders police probe against KT Jaleel for controversial Kashmir remarks

The former Kerala minister had described Pakistan-occupied Kashmir as "Azad Kashmir", and Jammu-Kashmir as India-occupied Jammu and Kashmir.

A sub-court in Thiruvalla in the Pathanamthitta district on Tuesday, August 23, directed the Kerala Police to register a case against legislator and former state higher education minister KT Jaleel, a fortnight after he courted controversy by describing Jammu and Kashmir as “India-occupied Jammu and Kashmir” and Pakistan-occupied Kashmir (PoK) as “Azad Kashmir”.

The court order is in response to a plea filed by RSS activist Arun Mohan.

In the lengthy Facebook post in Malayalam about his trip to Kashmir, Jaleel termed also opined that the Pakistan government did not have much influence in PoK.

“The portion of  Kashmir annexed to Pakistan is now known as Azad Kashmir. Pakistan has limited powers over the area and only controls the region’s currency and military. The Pakistan government is not wielding much power in PoK,” Jaleel said in his post.

He added that “India-occupied Kashmir” consisted of Jammu, the Kashmir Valley, and Ladakh, and the situation there was not very bright.

He said soldiers carrying guns could be seen all over Jammu and Kashmir. He said the people of Kashmir had forgotten laughter.

The former minister even went to the extent of saying the people of the region turned unhappy with the Union government’s abrogation of Article 370, apart from revoking Jammu and Kashmir’s special status.

The remarks evoked nationwide anger, with the BJP and the RSS accusing him of jeopardising national interests.

In the meantime, the Delhi Police has sought legal opinion on filing a case against Jaleel on the same matter based on a complaint by lawyer GS Mani at the Tilak Nagar Police Station. The complaint was transferred to the cyber police division of the Delhi Police.

Meanwhile, Congress MLA Mathew Kuzhalnadan filed a complaint against Jaleel with the Kerala Assembly Speaker, alleging that he violated the MLA code of conduct.
