Synopsis: In the affidavit opposing bail, the woman alleged that she was brutally raped, filmed nude, and threatened using the video. She told the court that the alleged video is still in Rahul’s possession and expressed fear that it could be released if he is granted bail.
Serious allegations have been raised against Palakkad MLA Rahul Mamkootathil in an affidavit filed by the complainant in the first rape case, which is set to be taken up again by the Kerala High Court on Wednesday, 21 January, while considering his plea for anticipatory bail.
In the affidavit opposing bail, the woman alleged that she was brutally raped, filmed nude, and threatened using the video. She told the court that the alleged video is still in Rahul’s possession and expressed fear that it could be released if he is granted bail.
Granting bail to an influential accused like Rahul, the affidavit said, would intimidate and silence future complainants.
The complainant further alleged that Rahul subjected her to repeated sexual assault in her Palakkad flat, forced her to undergo an abortion by threatening suicide, and continued to harass her using the purported video.
Photographs of injuries, along with chats and voice messages allegedly exchanged with the MLA, have been submitted to the court.
According to the affidavit, some of these messages contain threats.
The woman also claimed that the investigation team has information about around ten similar cases, including one involving a minor.
The Sessions Court had earlier rejected Rahul’s anticipatory bail plea in the first case registered by the Nemom police, following which he approached the High Court.
The High Court had stayed his arrest in that case and is now expected to hear the prosecution and the investigation team, which will also update the court on developments in the third rape case.
Meanwhile, Rahul remains in judicial remand in another case, in which he is accused of raping a non-resident woman after allegedly promising marriage and taking her to a hotel, resulting in pregnancy.
Three women have so far come forward with complaints against him.
Separately, Rahul has moved the Principal District and Sessions Court, Pathanamthitta, seeking bail in the third rape case after his plea was dismissed by the Judicial First Class Magistrate Court, Thiruvalla, on 17 January. The Sessions Court is scheduled to hear the matter on January 22.
