Poll code breach: FIRs registered against Karnataka Dy CM Shivakumar, HDK and BY Vijayendra

Shivakumar was booked for allegedly promising water supply in exchange for votes to residents of a housing society.

The Election Commission has registered separate FIRs against Karnataka Deputy Chief Minister DK Shivakumar, JD(S) chief HD Kumaraswamy, and BJP state president BY Vijayendra for violating different provisions of the Model Code of Conduct (MCC).

Shivakumar was booked for allegedly promising water supply in exchange for votes to residents of a housing society, the Election Commission said on Saturday, 20 April.

The matter came to light after the BJP approached the poll body seeking action against Shivakumar after a video of him seeking votes from the residents of a housing society in the Bengaluru Rural Lok Sabha constituency was shared widely on social media platforms.

Taking to social media platform ‘X’, the office of the Chief Electoral Officer (CEO) of Karnataka said that an FIR was lodged by the FST (Flying Squad Teams) of Bengaluru against Deputy Chief Minister DK Shivakumar for violation of MCC while addressing apartment owners in RR Nagara.

The FIR has been registered at RMC Yard police station under appropriate sections of the Indian Penal Code for bribery and undue influence at elections, it stated.

‘Business deal’

In the video clip, Shivakumar was purportedly heard saying that he had come for a “business deal” and if the 2,510 houses in the housing society — 6,424 votes — went to his candidate, he assured them that their major issues concerning the supply of Cauvery river water and need for a civic amenity site would be resolved by him within three months.

The RMC Yard police registered the FIR under various sub-sections of IPC 171.

Shivakumar’s brother DK Suresh is seeking re-election from Bangalore Rural in the Lok Sabha elections.

The CEO said the FIR against Kumaraswamy was registered for providing false statements. The FIR, No.149/2024, was registered at Gubbi police station under Section 123(4) of the Representation of the People Act and 171(G) of the IPC.

Vijayendra was booked for disturbing public tranquility. The Malleshwaram police registered the FIR under Section 125 of the Representation of the People Act and sections 171(G), 505, and 153(A) of the IPC.
