MUDA case: Karnataka HC issues notice to CM Siddaramaiah on plea challenging acceptance of Lokayukta police’s closure report

The Lokayukta police had earlier filed a B-Report against Siddaramaiah and others citing ‘lack of evidences’. Complainant Snehamayi Krishna has challenged this report.

Synopsis: A single-judge bench of Justice S Sunil Dutt Yadav also issued notices to Mysore Lokayukta, Superintendent of Police, Enforcement Directorate, Siddaramaiah’s brother-in-law Maiduna Mallikarjuna Swamy, former Muda Commissioner GT Dinesh Kumar and J Devaraju, the owner of the objectionable land in the case.

The Karnataka High Court on Thursday, 26 March, issued notices to Chief Minister Siddaramaiah and his wife, in connection with a petition challenging the action of the Special Court of People’s Representatives, which accepted the ‘B’ report in the alleged Mysore Urban Development Authority (MUDA) scam case.

A single-judge bench of Justice S Sunil Dutt Yadav also issued notices to Mysore Lokayukta, Superintendent of Police, Enforcement Directorate, Siddaramaiah’s brother-in-law Maiduna Mallikarjuna Swamy, former Muda Commissioner GT Dinesh Kumar and J Devaraju, the owner of the objectionable land in the case.

On 28 January the trial court had accepted a B report filed by Superintendent of Police Karnataka Lokayuktha in the alleged scam.

According to Livelaw, in the plea before the High Court, the petitioner seeks that investigation in Crime No. 11/2024 be transferred to an independent investigating agency.

The petitioner also seeks a direction to conduct a fresh investigation into the alleged offences. The said investigating agency should be directed to submit a fresh report under Section 173 of the Cr.P.C. (now corresponding to Section 193 of BNSS), the plea states. Such investigation be monitored by a retired judge of the Karnataka High Court, the plea seeks.

The MUDA case

The MUDA case involves allegations that Chief Minister Siddaramaiah’s family misused public office to receive 14 prime residential plots in Mysuru as compensation for alleged encroachment of 3.16 acres of land by MUDA. 

The land was allotted under the controversial 50:50 scheme, where MUDA provides 50% of developed land in exchange for acquired land.

Siddaramaiah’s wife, Parvathi, was among the beneficiaries of the allotment. Opposition BJP leaders have alleged that the scam could be worth ₹4,000–5,000 crore, and have launched sustained protests calling for accountability and an independent probe.
