Synopsis: SPP Prof Ravivarma Kumar appearing for the SIT, said, “Cognizance of the chargesheet is taken by the court. Therefore, petition challenging the FIR is not maintainable,” adding “Not only chargesheet has been filed but investigation has concluded, and cognizance has been taken.”
Karnataka High Court on Monday, 1 September heard a petition filed by JD(S) leader HD Revanna seeking to quash the case registered accusing him of kidnapping a woman.
SPP Prof Ravivarma Kumar appearing for the SIT, said, “Cognizance of the chargesheet is taken by the court. Therefore, petition challenging the FIR is not maintainable,” adding “Not only chargesheet has been filed but investigation has concluded, and cognizance has been taken.”
Senior Advocate CV Nagesh appearing for petitioner noted, “Despite stay order the court has taken cognizance. Therefore, it cannot be taken note of. As of now cognizance against the petitioner is not taken is my submission. What I have sought is quashing of FIR for offence reg and made penal under section 354(A),354(D),504 & 506 IPC.”
The Court has adjourned the hearing, and will further continue on Tuesday, 2 September.
Former minister and MLA HD Revanna and his son Prajwal, had allegedly sexually assaulted several women employed as maids in their house, according to the Special Investigation Team (SIT) of the Karnataka police.
Two cases — kidnapping and sexual abuse — have been registered against Revanna, son of JD(S) patriarch and former prime minister HD Deve Gowda.
Both Revanna and his accomplice Satish Babanna were booked by KR Nagara Police Station in Bengaluru on 2 May 2024 for kidnapping the woman.
The case was registered following a complaint by the woman’s son, who alleged that his mother was sexually abused by Revanna’s son Prajwal. The woman was allegedly abducted to prevent her from testifying against Prajwal, police sources said.
While he was arrested on 4 May, 2024, Special Court of Elected Representatives’, on 13 May 2024, granted him bail, which was upheld by the Karnataka High Court.
Earlier this month, a Special Court in Bengaluru has sentenced former JD(S) MP Prajwal Revanna to life imprisonment in the farmhouse rape case registered against him at the Holenarasipura Rural Police Station.
A fine of ₹10 lakh, too, has been imposed on him, of which ₹7 lakh must be given to the survivor.
