Bengaluru resident demands Rs 50 lakh compensation from BBMP for poor road maintenance

Synopsis: A Bengaluru resident served a legal notice to the BBMP asking for compensation to cover medical expenses, physical suffering caused by the failure to maintain public roads.

A Bengaluru resident served a legal notice to the Bruhat Bengaluru Mahanagara Palike (BBMP) alleging gross negligence and failure in discharging public duty.

In the notice served to BBMP dated 14 May, Dr Divya Kiran S has asked for a compensation of ₹50 lakhs for undergoing physical, emotional and financial burden. This compensation is to cover medical expenses, physical suffering caused by the failure to maintain public roads.

According to details in the notice, Kiran has suffered neck and back pain, which has been medically linked to the jerks and trauma caused while commuting on Bengaluru roads.

‘Undergoing extreme pain, trauma, and suffering’

Advocate KV Laveen sent the legal notice on behalf of Kiran said he is a resident of Richmond Town and was constrained to send this legal notice owing to the extreme pain, trauma, and suffering he has undergone due to the poor condition of roads under the jurisdiction of BBMP, including deep potholes, broken and uneven pathways, and unmotorable road surfaces.

He said, despite being a tax-paying citizen with a right to safe public infrastructure, he had been subjected to continuous physical hardship and mental agony as a result of BBMP’s blatant failure to maintain basic civic infrastructure.

Kiran said he suffered severe neck and back pain, which has been medically linked to the jerks and trauma caused while commuting on these “treacherous roads”.

The letter said he was forced to visit five orthopaedic specialists due to the intensifying pain and had to make four emergency visits to St. Philomena’s Hospital, undergoing injections and procedures to relieve acute agony.

“Further, have been on multiple medications and painkillers to manage the condition. He has also experienced episodes of crying out in pain, loss of sleep, anxiety, and mental distress, all of which have deeply affected his well-being and daily functioning,” the letter said.

Asks to pay compensation

He said he has been undergoing continuing physical agony, emotional trauma, and financial burden due to BBMP’s gross negligence and failure in discharging its public duty and demanded a compensation of ₹50 lakh for medical expenses, emotional distress and mental anguish, physical suffering and loss of normal life, costs of travel for medical consultations, and overall trauma caused by the failure to maintain public roads.

The lawyer said further legal actions and criminal cases will be initiated against BBMP if it fails to pay the amount within 15 days from the date of the notice. He said the BBMP is liable to pay all kinds of expenditures, costs and risk.

Your failure to respond and act within 15 days from the date of receipt of this notice will compel me to initiate appropriate legal action including, but not limited to: Filing a civil suit for damages, Filing a Public Interest Litigation (PIL) in the Hon’ble High Court of Karnataka, Approaching the Lokayukta, State Human Rights Commission, and other relevant legal forums.

Kiran also asked the BBMP to pay the charges for the legal notice, ₹10,000.
