Synopsis: The Special Court decided to hold daily hearings after the ED filed a writ petition in September, saying the trial of the money laundering cases registered against Jagan and others is delayed. It also sought orders requiring all the accused in the cases to appear before the court in person. In its petition, the ED said the trial of the main cases remained stalled at the initial stage because arguments and decisions on discharge petitions were incomplete.
In a major development, the Special CBI Court in Nampally, Hyderabad, decided to hold daily hearings in disproportionate assets cases involving YSR Congress Party president and former Andhra Pradesh chief minister YS Jagan Mohan Reddy.
The court decided on daily hearings on Wednesday, 14 October, based on an Enforcement Directorate (ED) petition. In addition to ED cases, the court will also hear CBI-registered cases.
The court focused on expediting the trial of the ED cases involving Jagan and other accused. About 73 accused are in these cases. This latest development came after the ED approached the court over the lack of progress in nine of its cases that have been pending for nearly 10 years.
The ED filed a writ petition (Number 33845/2026), saying the trial of the money laundering cases registered against Jagan and others has been delayed. It also sought orders requiring all the accused in the cases to appear before the court in person. In its petition, the ED said the trial of the main cases remained stalled at the initial stage because arguments and decisions on discharge petitions were incomplete.
On 9 October, the Telangana High Court ordered that this petition be heard jointly with two other previously filed petitions. The bench directed the registry to list the ED’s 23 September petition alongside the Public Interest Litigation (PIL) filed by Jana Sena leader Chegondi Harirama Jogaiah and a petition the High Court took up suo motu on the same issue. It directed that these petitions be listed for hearing on 13 October.
Between 2016 and 2021, the ED filed nine prosecution complaints against Jagan and others under the Prevention of Money Laundering Act (PMLA), 2002, in the Special Court for CBI cases at Nampally. The ED stated that although the court took cognizance of all these complaints, the cases have not moved past the preliminary stage as final decisions have not been pronounced on the discharge petitions filed by the accused.
The investigation agency argued that although arguments on the discharge petitions had taken place in the past, final orders were not issued due to various reasons, including the transfer of judges. In its arguments, the ED noted that having to restart arguments from the beginning every time new judges assumed charge also contributed to the delay. Under these circumstances, the ED opined that the cases have not reached subsequent stages such as the framing of charges against the accused, examination of witnesses, and final judgment.
The cases revolve around government decisions made between 2004 and 2009 when YS Rajasekhara Reddy was the chief minister of united Andhra Pradesh, the companies alleged to have benefited from them, and the investments made in companies linked to Jagan’s family.
Investigation agencies alleged that in return for favorable government decisions granted to certain companies and individuals, investments were made into firms associated with Jagan or his family members. While the CBI took up the investigation terming these allegations as ‘quid pro quo’, the ED registered cases from a money laundering angle regarding the financial transactions related to the affair.
As part of its investigation, the ED mentioned investments by several individuals as well as companies such as Aurobindo Pharma, Hetero Drugs, Indu Projects, Indu Techzone, Lepakshi Knowledge Hub, VANPIC Projects, VANPIC Ports, Ramky Pharma City, and India Cements.
The ED’s main allegation is that investments were made at inflated valuations in the purchase of shares related to companies like Bharathi Cement Corporation, Jagati Publications, and Janani Infrastructure. The ED approached the Telangana High Court to expedite the cases pending against Jagan Mohan Reddy for nearly 10 years.
On 10 October, the ED released a statement stating that it had filed a writ petition to this effect on September 23. It requested the court to ensure that all the accused in this case attend in person. Most recently, the Special CBI Court decided to conduct daily hearings in the CBI cases along with the ED cases.
